Cross-Border Bankruptcy Issues

This panel discusses recent decisions involving eligibility issues (Suntech, Barnet and Octaviar) and a potential retreat from principles of comity underlying chapter 15 (Fairfield Sentry, Quimonda and Madoff). The panel also discusses other significant cross-border bankruptcy issues such as the sale of SIPA claims (Fairfield Sentry), enforcement of U.S. judgments in foreign jurisdictions (Argentina litigation and Madoff), the filing of chapter 11 cases by foreign debtors (Alsacia), extraterritoriality issues regarding avoidance actions (Madoff), and the allocation of proceeds between U.S. debtors and foreign debtors (Nortel).
