This panel discusses such recent decisions as Momentive, ResCap, Fisker and Free Lance-Star Publishing, which have the potential to affect secured creditor rights in a variety of situations, such as cramdown interest rates, the extent of a security interest, credit-bidding, the date of collateral valuation, the availability of pre-bankruptcy and debtor-in-possession financing, and contested confirmations. The panel also discusses the changes proposed in the ABI Reform Commission's Final report relating to secured creditor rights.
