Topics to be covered will include corporate finance transactions such as tender offers or exchange offers (including coercive exchange offers); convertible debt; PPP funding challenges and impacts; managing confidentiality/NDA issues; dealing with ad hoc committees and crossover committees; restructuring support agreements/death-trap provisions; and strategies for garnering creditors’ support for a restructuring when no formal or informal committee structure is present for creditors.

Disparate Treatment of POC in the Bankruptcy Process
This session will focus on several of the Model Rules of Professional Conduct, including 1.1 (Competence), 8.4 (Misconduct), and ABA's Model Code of Judicial Conduct canon 2.3(b) (Bias, Prejudice, and Harassment). The panelists will discuss the disparate treatment of people of color in the bankruptcy process, whether it is open or hidden, and how that treatment manifests itself. This session will also address research that has been conducted regarding biases and perceptions on race and bankruptcy, including decisions on filing and under what chapter to file, and what the bar and the judiciary can do to correct that disparate treatment.

NY MCLE: This transitional and nontransitional program has been approved in accordance with the requirements of the CLE Board for a maximum of 7.75 credit hours, of which 1.25 hour of credit can be applied toward the ethics professionalism requirement. California MCLE: ABI certifies that this activity has been approved for MCLE credit in the amount of 7.75 hours, of which 1.5 hour will apply to ethics.

When and how can I access the virtual conference?
Registered attendees will receive a link via email to the attendee website 48 hours before the first session begins. The link will be sent to the email address you used to register for the program, and this is how you will access all of the conference content. You’ll use the same link each day to access the attendee website for the live conference and whenever you choose to view the on-demand content.

How much time should I expect to be online during the event days?
The virtual conference sessions take place for approximately 4.5 hours on Thursday afternoon and Friday morning.

You will be able to access the program sessions without downloading any plug-ins or software.
