ABI RELEASES NEW AUTO SUPPLIER INSOLVENCIES AND BANKRUPTCIES MANUAL

September 25, 2006, Alexandria, Va. — The American Bankruptcy Institute (ABI) has released the Auto Supplier Insolvencies & Bankruptcies: Issues for Suppliers and Customers of Financially Troubled Auto Suppliers manual, a new publication providing strategies for buyers and sellers in the auto supply chain both prior and subsequent to a supplier's bankruptcy filing. The manual was written by the Creditors' Rights Department of Barnes & Thornburg LLP and edited by Prof. James J. White of the University of Michigan Law School.

The timely manual features suggestions for legal strategies related to auto supplier insolvency, including discussions of:

  • Article 2 of the Uniform Commercial Code as it relates to automotive suppliers and customers
  • Accommodation agreements
  • Access and security agreements
  • Parts banks
  • Special tooling lien acts for cases prior to and after the implementation of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005.

Auto equipment manufacturing concerns have been under financial stress due to high fuel prices and competitive pressures. Delphi, a former GM unit, was one of five filings in 2005 by auto industry manufacturers and Dana Corp. filed in early 2006.

The 270-page softbound manual is available for purchase at ABI’s Online Bookstore. Click here to order.
