Flores of Rhode Island Legal Services (Providence, R.I.), the book is primarily intended to be used by legal professionals, especially those who possess a general understanding of either U.S. bankruptcy law or U.S. intellectual property law and who want to be aware of some of the issues that may arise when these two bodies of law interact. Choppy Waters offers a compendium of the various types of intellectual property and unique claims and other issues that may arise in the context of litigation with respect to intellectual property; a discussion of the basic framework of both intellectual property laws and bankruptcy law; an introduction to some of the issues that may arise when intellectual property rights collide with the bankruptcy process, including the treatment of intellectual property license agreements as executory contracts in bankruptcy; and, finally, the sale of intellectual property in bankruptcy, and important recent cases, such as the Supreme Court’s decision in Tempnology.
