Impact of the In re Millennium Lab Holdings II, LLC Decision, Claims Trading, Safe Harbors and More to Be Discussed at ABI's Views from the Bench Program on Sept. 21

Alexandria, Va. — ABI’s popular “Bankruptcy 2018: Views from the Bench” program will take place on Sept. 21 at The Georgetown University Law Center in Washington, D.C. The program features the views of 17 bankruptcy judges from New York, New Jersey, Delaware, D.C., Maryland, Virginia, Pennsylvania, Florida, Texas and Georgia. This year’s program will examine a number of current bankruptcy topics, including claims trading, safe harbors and UFTA immunity, the impact of the In re Millennium Lab Holdings II, LLC decision and more. Attendees have the chance to earn up to 6 hours of CLE credit. The chair of the “Views from the Bench” program is David R. Kuney of Whiteford Taylor Preston, LLP (Washington, D.C.)

Two great debates, moderated by Norman N. Kinel of Squire Patton Boggs (New York), will be the centerpiece of the program. Bankruptcy Judge Dennis R. Dow (W.D. Mo.; Kansas City) will debate Bankruptcy Judge Marvin Isgur (S.D. Tex.; Houston) about whether, under Till v. SCS Credit Corp., a bankruptcy court is required to use a two-step approach to determine the cramdown interest rate and must first determine whether there is an efficient market before it can use the formula approach. Craig Goldblatt of Squire Patton Boggs (New York) will also debate Michael L. Bernstein of Arnold & Porter Kaye Scholer LLP (Washington, D.C.) on whether a trademark licensee retains the right to use a debtor’s trademark post-rejection.
