NEW OFFICERS AND BOARD MEMBERS ELECTED AT ABI’S 24TH ANNUAL SPRING MEETING

 

April 26, 2006, Alexandria, Va. — The following officers and members of the Board of Directors of the American Bankruptcy Institute (ABI) were elected to leadership positions at ABI’s Annual Spring Meeting, held April 20-April 23 in Washington, D.C.:

New members of the Executive Committee and new officers: Judge Wesley Steen of the U.S. Bankruptcy Court of the Southern District of Texas (Houston) becomes President for a one-year term, succeeding John Penn of Haynes & Boone LLP (Fort Worth, Texas). Judge Steen is the first sitting judge to serve as ABI President. Reggie Jackson of  Vorys, Sater, Seymour and Pease LLP (Columbus, Ohio) was named President-Elect, to become President in April 2007. Michael P. Richman of Mayer, Brown, Rowe & Maw LLP (New York) succeeds Bettina M. Whyte of MBIA Insurance Corporation (Armonk, N.Y.) as Chair of the Board for a one-year term. Robert J. Keach of Bernstein, Shur (Portland, Maine) was named to a two-year term as Vice President-Education, succeeding Neil P. Olack, who will become a bankruptcy judge in Mississippi. James Patrick Shea of Shea & Carlyon, Ltd. (Las Vegas) was named to a one-year term as a Member at Large on the 16-member Executive Committee.

REGINALD W. JACKSON NAMED ABI PRESIDENT-ELECT

May 1, 2006, Alexandria, Va. The American Bankruptcy Institute (ABI) announces that Reginald W. Jackson of Vorys, Sater, Seymour & Pease LLP (Columbus, Ohio) has been selected by the ABI Board of Directors to be President-Elect. He will become President for a one-year term, beginning with ABI’s Annual Spring Meeting in 2007. He has been an ABI member since 1992 and has served on the 60-member ABI Board of Directors since 2002 and as the Executive Editor of the ABI Journal since March 2002, in addition to serving on ABI’s Publications Committee.

Jackson is a partner at Vorys, Sater, Seymour and Pease LLP and has practiced for 25 years in the corporate restructuring, workout and bankruptcy areas with an emphasis on representing secured creditors, creditors' committees and debtors in chapter 11 reorganization proceedings and workouts. He is a fellow of the American College of Bankruptcy, having been inducted in 2001. Jackson received his J.D. from the University of Pennsylvania Law School in 1980 and his B.A. from Cornell University in 1977.

Jackson is also a member of the Columbus Bar Association, where he has served on the Board of Governors and for which he served as the chairman of its Bankruptcy Committee from 1990-92; the American Bar Association (member, Business Law Section, Business Bankruptcy Committee, Chapter 11 and Executory Contracts Subcommittee); the Ohio State Bar Association, where he serves as District 7 Representative on the Board of Governors and was on the Council of Delegates for 2002-05; and the Ohio State Bar Foundation, for which he served as president in 2001. Jackson has been named one of “America's Top Lawyers” by Black Enterprise Magazine.

U.S. Households File for Bankruptcy at Record Levels in 2005

U.S. HOUSEHOLDS FILE FOR BANKRUPTCY AT RECORD LEVELS IN 2005

April 17, 2006, Alexandria, Va. — As consumers filed for bankruptcy in record numbers in 2005, the American Bankruptcy Institute (ABI) found that there was one personal bankruptcy for every 60 U.S. households in calendar year 2005, a record level driven largely in response to families looking to file for bankruptcy protection prior to the implementation the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA). This is a 23 percent increase from calendar year 2004, which showed that nearly one out of 79 households filed for bankruptcy.

“The latest report underscores the level of financial stress for U.S. families,” said Samuel J. Gerdano, ABI Executive Director. “It also reflects the fear, if not panic, surrounding the effect of the new bankruptcy law,” he added.

The data can be viewed at http://www.abiworld.org/stats.  The table, based on data from the Administrative Office of the U.S. Courts (2005 non business bankruptcies as of December 31, 2005) and the U.S. Bureau of the Census (U.S. household unit estimates as of July 1, 2004), ranks households per filing by state and nationally. The five states with the highest bankruptcy household-per-filing rates are Indiana, Ohio, Utah, Tennessee and Oklahoma. States with the lowest rates include South Carolina, Alaska, Vermont, the District of Columbia and Hawaii. By contrast, states with the highest bankruptcy household-per-filing rates in calendar year 2004 were Utah, Tennessee, Georgia, Alabama and Indiana. The states with the lowest rates in 2004 included Vermont, Alaska, Hawaii, Maine and Massachusetts.

Judge Wesley Steen Becomes First Judge to be Named ABI President

JUDGE WESLEY STEEN BECOMES FIRST JUDGE

TO BE NAMED ABI PRESIDENT

 

May 1, 2006, Alexandria, Va. — As the first sitting judge to serve as President of the American Bankruptcy Institute (ABI), Judge Wesley Steen of the U.S. Bankruptcy Court of the Southern District of Texas (Houston) began his one-year term following ABI’s Annual Spring Meeting, which was held April 20-April 23 in Washington, D.C. Judge Steen, previously serving as president-elect after being selected by the ABI’s 60-member Board of Directors at the 2005 Annual Spring Meeting, succeeds John Penn of Haynes and Boone LLP (Fort Worth, Texas), who now assumes the role of Immediate-Past President within ABI’s Executive Committee.

Judge Steen has been an ABI member since 1991, having served on ABI’s Board of Directors since 1999, and was previously ABI’s Vice President-Research, overseeing the Research Grant Committee in assessing, recommending and approving awards from the Endowment Fund prior to his 2005 selection as ABI President.

Judge Steen became a U.S. Bankruptcy Judge for the Southern District of Texas in 1997 and hears cases in Houston, Laredo and Victoria, Texas.  He was first appointed to the bench in 1983 as a U.S. Bankruptcy Judge for the Middle District of Louisiana.  He is a member of the Board of Governors of the National Conference of Bankruptcy Judges. He practiced law at Winstead Sechrest & Minick in Houston from 1987-97. Judge Steen received his J.D. from Louisiana State University in 1974 and his B.A. with distinction from the University of Virginia in 1968.

JONATHAN P. FRIEDLAND ELECTED TO ABI’S BOARD OF DIRECTORS

May 3, 2006, Alexandria, Va. The American Bankruptcy Institute (ABI) announces that Jonathan P. Friedland of Kirkland & Ellis LLP (Chicago) has been elected to ABI’s Board of Directors. An active member since 1995, Friedland participates on the Advisory Board for ABI’s Law Review and is a contributing editor to theABI Journal. He will serve a term of three years on the 60-member ABI Board of Directors.

A partner in Kirkland & Ellis’ Restructuring Group, Friedland concentrates his practice on financial and operational restructurings, including out-of-court workouts and chapter 11 reorganizations and representation of buyers and sellers of distressed assets. In 2005, Friedland was selected as an “Illinois Super Lawyer” by Chicago Magazine. He received his J.D. from the University of Pennsylvania Law School in 1994 and his B.S. with highest honors in 1991 from the State University of New York at Albany.

ABI’s SOUTHEAST BANKRUPTCY WORKSHOP

April 24, 2006, Alexandria, Va. —More than 400 attendees and eight bankruptcy judges will participate in ABI’s Eleventh Annual Southeast Bankruptcy Workshop, to be held July 26-29, 2006, at The Ritz-Carlton on Amelia Island, Fla.  The workshop brings together this region’s top insolvency professionals for three days of intense learning and networking, with the opportunity to earn 13.5 hours of CLE credits, including 1.5 hours of ethics.

ABI Poll Companies Operating Under Chapter 11 Protection Enjoy an Unfair Competitive Advantage

ABI POLL: COMPANIES OPERATING UNDER CHAPTER 11 PROTECTION ENJOY AN UNFAIR COMPETITIVE ADVANTAGE

April 28, 2006, Alexandria, Va. — A majority of overall respondents (57 percent) to the most recent American Bankruptcy Institute (ABI) online poll agreed that companies operating under chapter 11 protection enjoy an unfair competitive advantage. The largest category of respondents, 31 percent, weighed in that they “somewhat agreed” that companies had an unfair advantage while operating under chapter 11 protection, while 26 percent “strongly agreed.” 

Only 35 percent of the respondents did not agree that companies operating under chapter 11 protection had an unfair competitive advantage. Of the 35 percent, 19 percent “somewhat disagreed” that companies in chapter 11 had an unfair advantage, while 16 percent “disagreed strongly.” Eight percent of respondents did not have an opinion or did not know enough about the issue.

ABI membership and members of the public were welcome to submit their response to the statement “Companies operating under chapter 11 protection enjoy an unfair competitive advantage” for the recent poll that was open for voting from April 13 – April 27. The poll question is based on the recent high-profile bankruptcies of companies operating in highly competitive industries as the automotive, airline and steel industries.

RUDY J. CERONE ELECTED TO ABI’S BOARD OF DIRECTORS

May 3, 2006, Alexandria, Va. The American Bankruptcy Institute (ABI) announces that Rudy J. Cerone of McGlinchey Stafford, PLLC (New Orleans) has been elected to ABI’s Board of Directors. An active member since 1997, Cerone currently serves as co-chair of the Bankruptcy Litigation Committee and participates on ABI’s Health Care and Business Reorganization Committees. Cerone has also taken a leading role in the development of ABI’s Litigation Skills program. He will serve a term of three years on the 60-member ABI Board of Directors.

Cerone is a member of the firm’s commercial litigation section with primary emphasis in the areas of business bankruptcy and commercial litigation. He was named to be a Fellow of the American Bankruptcy College in 2001 and is certified as a specialist in business bankruptcy law by both the American Board of Certification, of which Cerone served as President in 2004 and Chair of the Board of Directors in 2005, and the Louisiana State Bar Association Board of Legal Specialization. Cerone received his J.D. with honors from Boston College in 1979 and his B.A. with highest honors in history at the University of California at San Diego in 1976.

ABI’s BOSTON BANKRUPTCY CLE AND OUTREACH EVENT FOCUSES ON NEW OBLIGATIONS FOR PRACTITIONERS

May 5, 2006, Alexandria, Va. — Practitioners looking to understand the ethical and other obligations created by the new bankruptcy law should plan to attend the American Bankruptcy Institute’s (ABI) 'New Obligations for Practitioners under the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA)' event on May 25, 2006 at the John Joseph Moakley U.S. Courthouse in Boston, Mass. This afternoon session features a distinguished panel addressing the new duties as they relate to debtors’ counsel, creditors’ counsel, trustees, U.S. Trustees, creditor committees, DIPs and investment bankers. Attendees have the opportunity to earn 1.5 CLE credits and enjoy a complimentary networking reception following the panel discussion.

The panel session will explore the new law as it brings changes to bankruptcy professionals from all perspectives. May 10, 2006, Alexandria, Va. The American Bankruptcy Institute (ABI) announces that Prof. Margaret Howard of Washington & Lee University Law School (Lexington, Va.) has been elected to ABI’s Board of Directors. An active member since 2002, Prof. Howard is a former ABI Robert M. Zinman Resident Scholar (Spring 2002) and participates in the activities of ABI’s Asset Sales Committee. She will serve a term of three years on the 60-member ABI Board of Directors.

A professor of Law at Washington & Lee University since 2001, Howard’s teaching focuses on bankruptcy, commercial law and contracts. She is the John W. Elrod Law Alumni Association Fellow in Teaching Excellence and a member of the American Law Institute. She is also the author of the ABI publication Bankruptcy Overview. Prof. Howard received her J.D. from the Washington University in 1975 and B.A. from Duke University in 1969.
