David Gaffey of Whiteford, Taylor & Preston, LLP Selected as One of ABI's 2023 "40 Under

ABI announces that David Gaffey of Whiteford, Taylor & Preston, LLP (Falls Church, Va.) has been selected as one of ABI’s “40 Under 40,” ABI’s award program that recognizes 40 of the top insolvency industry professionals under the age of 40. Gaffey is a partner in Whiteford, Taylor & Preston, LLP’s Business Solutions, Restructuring & Financial Litigation Group. He focuses his practice on bankruptcy and restructuring matters, the purchase and sale of distressed assets, and advising distressed and insolvent companies. Gaffey specializes in representing debtors, secured and unsecured creditors, creditors’ committees, debtor-in-possession financing lenders, trustees and distressed companies in chapter 11 reorganizations, chapter 7 liquidations, out-of-court workouts, involuntary bankruptcies, bankruptcy litigation, and other insolvency and default matters. Michael Fishel of King & Spalding Selected as One of ABI's 2023 "40 Under 40"

Alexandria, Va. ABI announces that Michael Fishel of King & Spalding (Houston) has been selected as one of ABI’s “40 Under 40,” ABI’s award program that recognizes 40 of the top insolvency industry professionals under the age of 40. The honorees will be recognized at a special ceremony on Dec. 1 at ABI’s 2023 Winter Leadership Conference at the Fairmont Scottsdale Princess in Scottsdale, Ariz.

Fishel is a restructuring partner with King & Spalding. His primary focus is advising both debtor and creditor clients through complex chapter 11 restructurings, out-of-court reorganizations and refinancings, distressed and opportunistic acquisitions, and contested business litigation proceedings. He represents clients in various market sectors, including energy, retail, health care, tech, travel and pharmaceuticals. Fishel enjoys mentoring associates and was a permanent mentor at his previous firm’s 1L Diversity Program. He currently leads the firm’s restructuring group’s comprehensive overhaul of its knowledge management system. In three months, he helped to rebuild its database of internal knowledge and reference tools, something that is now used as a model for other practice groups. In addition, he was recently certified by the Emerging Leader Development Program at the Northwestern Kellogg School, an executive leadership education program.

Fagen is a restructuring partner with Kirkland & Ellis LLP. His practice involves representing debtors and creditors in out-of-court restructurings and chapter 11 cases. He has a broad range of restructuring experience across multiple industries, including retail, technology and energy. Fagen has been published in scholarly and trade publications, including the Journal of Corporate Renewal and the New York Law Journal. He also has been recognized as a leading lawyer by Chambers USA and Lawdragon 500, and he was recognized by The Legal 500 United States for Restructuring: Corporate for 2023. Within the firm, Fagen leads its annual “mock board” training program, where he organizes an annual competition between teams of Kirkland associates and junior bankers, who present to independent directors and other senior restructuring professionals. Joseph Esmont of BakerHostetler Selected as One of ABI's 2023 "40 Under 40"

Alexandria, Va. ABI announces that Joseph Esmont of BakerHostetler (Cleveland) has been selected as one of ABI’s “40 Under 40,” ABI’s award program that recognizes 40 of the top insolvency industry professionals under the age of 40. Esmont is a partner with BakerHostetler, which he joined straight out of law school in 2008, two weeks before Lehman Brothers collapsed. His practice includes both plaintiff- and defense-side litigation, restructuring and transactional work. He is particularly experienced in the energy and utilities industries, in cases of mass torts and fraud, and in the impact of bankruptcy on environmental obligations. Esmont is listed in Lawdragon 500 Leading U.S. Bankruptcy and Restructuring Lawyers for 2023, and he chaired the Turnaround Management Association’s Global Nextgen Committee in 2020, on which he served for five years. He also served on TMA Global’s special Diversity, Equity & Inclusion Committee in 2020 and has served on the Global Awards Committee since 2021. Michael Dunn of Dunn Law PA Selected as One of ABI's 2023 "40 Under 40"

Alexandria, Va. ABI announces that Michael Dunn of Dunn Law PA (Miami) has been selected as one of ABI’s “40 Under 40,” ABI’s award program that recognizes 40 of the top insolvency industry professionals under the age of 40. The honorees will be recognized at a special ceremony on Dec. 1 at ABI’s 2023 Winter Leadership Conference at the Fairmont Scottsdale Princess in Scottsdale, Ariz.

Dunn is the founder and managing partner of Dunn Law, P.A, with attorneys licensed to practice in Florida, New York and Alabama. He concentrates his practice in insolvency with an emphasis on bankruptcy and commercial litigation, and he regularly represents trustees and fiduciaries, banks, creditors, debtors and distressed-asset purchasers. In addition, Dunn regularly serves as a court-appointed fiduciary in both state and federal matters, including as a court-appointed fiduciary in a Securities and Exchange Commission enforcement action in connection with a cryptocurrency fraud, as temporary receiver in a Federal Trade Commission enforcement action, and in several Florida assignments for the benefit of creditors. He is a Florida Supreme Court Certified Circuit Civil Mediator, Florida Supreme Court Qualified Arbitrator, and Florida licensed title agent.

Dunn recently concluded the 2022-23 term as president of the Bankruptcy Bar Association of the Southern District of Florida, during which time he launched a law student summer scholar program and helped revitalize and expand the BBA’s financial literacy and community outreach programming, after having served in elevating roles on the BBA’s executive board for the last six years. Elizabeth Downing of Skadden Arps Slate Meagher & Flom LLP Selected as One of ABI's 2023 "40 Under 40"

She was selected in 2023 to the NextGen Leadership Program of the International Insolvency Institute in recognition of the leadership roles she has taken on in various multinational, complex cross-border insolvency cases. Kathleen DiSanto of Bush Ross, P.A. Selected as One of ABI's 2023 "40 Under 40"

Alexandria, Va. ABI announces that Kathleen DiSanto of Bush Ross, P.A. (Tampa, Fla.) has been selected as one of ABI’s “40 Under 40,” ABI’s award program that recognizes 40 of the top insolvency industry professionals under the age of 40. The honorees will be recognized at a special ceremony on Dec. 1 at ABI’s 2023 Winter Leadership Conference at the Fairmont Scottsdale Princess in Scottsdale, Ariz.

DiSanto is a shareholder and Bankruptcy Practice Group leader with Bush Ross, P.A., where her practice primarily focuses on bankruptcy and insolvency matters. She also is an experienced litigator in state and federal courts throughout the state of Florida and regularly represents debtors and assists them in navigating business bankruptcy. DiSanto also is a Florida Supreme Court Certified Circuit Mediator and serves as a Subchapter V trustee in small business cases filed under the Small Business Reorganization Act of 2019. She has been Board Certified in Business Bankruptcy Law by the American Board of Certification since 2014 and serves as a director on its Standards Committee, and she has been rated AV-Preeminent by Martindale-Hubbell since 2015. DiSanto also was the youngest president of the Tampa Bay Bankruptcy Bar Association when she served from 2020-21, and she has been listed in The Best Lawyers in America since 2020, as a Florida Super Lawyers “Rising Star” from 2013-22 and “Super Lawyer” in 2023, and as a Florida Trend “Legal Elite Up and Comer” for 2012, 2017, 2018 and 2021. She currently serves as a director on the board of the Middle District of Florida Pro Se Assistance Clinic, Inc., a Florida nonprofit corporation. She also serves as the regional financial supervisor for her sorority, Gamma Phi Beta, through which she empowers collegiate women to manage their chapters’ finances, helping them through the budgeting and accounting process. She also serves as a member of the board of directors for the International Women’s Insolvency & Restructuring Confederation’s Florida Network, for which she plans and directs continuing education and networking events like the Table for 8 series with local judges, and volunteers for community service projects like the Reverse Advent Calendar Food Drive, which collects and donates food to local charities during the holidays.

Daniel Desatnik of Proskauer Rose LLP Selected as One of ABI's 2023 "40 Under 40"

Megan Clontz of Spencer Fane LLP Selected as One of ABI's 2023 "40 Under 40"

Alexandria, Va. ABI announces that Megan Clontz of Spencer Fane LLP (Plano, Texas) has been selected as one of ABI’s “40 Under 40,” ABI’s award program that recognizes 40 of the top insolvency industry professionals under the age of 40. The honorees will be recognized at a special ceremony on Dec. 1 at ABI’s 2023 Winter Leadership Conference at the Fairmont Scottsdale Princess in Scottsdale, Ariz.

Clontz is Of Counsel at Spencer Fane LLP, where she represents debtors and secured and unsecured creditors in bankruptcy and nonbankruptcy insolvency matters, with a focus on small business reorganizations and restructurings, and debtor and creditor rights litigation in both state and federal courts. She also has experience representing debtors and creditors in consumer bankruptcy cases under chapters 7, 11 and 13, and in complex consumer mortgage litigation. Clontz currently chairs the DFW Network of the International Women’s Insolvency & Restructuring Confederation (IWIRC) and is the most recent past chair of the Bankruptcy and Commercial Law Section of the Dallas Bar Association. She previously served on boards for the State Bar of Texas Bankruptcy Section’s Young Lawyers Committee and the Dallas-Fort Worth Association of Young Bankruptcy Lawyers, on the Junior League of Dallas’s Leadership Council, and in leadership positions with the Girl Scouts of Northeast Texas and other local nonprofit organizations. She also was a proponent of and integral to the formation of the new IWIRC-Central Texas Network, founded in 2023, and she is a member of ABI, IWIRC, the Hon. John C. Ford American Inn of Court, the Texas Women of Bankruptcy group, and several local bar associations.

Clontz has prioritized volunteerism and mentorship throughout her career. While in law school, she earned the Dean’s Community Service Award and Order of the Samaritan from the University of Alabama School of Law for her volunteer work with the IRS Volunteer Income Tax Assistance (VITA) program, and she continues her work through local alumni associations, nonprofit organizations and her church. She also recently helped with the “Roadways to the Bench—Who, Me? A Bankruptcy or Magistrate Judge?” diversity outreach program in the Northern District of Texas.

Rachel Chesley of FTI Consulting, Inc. Selected as One of ABI's 2023 "40 Under 40"

Alexandria, Va. ABI announces that Rachel Chesley of FTI Consulting, Inc. (New York) has been selected as one of ABI’s “40 Under 40,” ABI’s award program that recognizes 40 of the top insolvency industry professionals under the age of 40. The honorees will be recognized at a special ceremony on Dec. 1 at ABI’s 2023 Winter Leadership Conference at the Fairmont Scottsdale Princess in Scottsdale, Ariz.

Chesley is a senior managing director with FTI Consulting, Inc. and leads the restructuring offering within the company’s Strategic Communications segment, providing counsel to companies, boards of directors, lenders, creditors and buyers as they prepare for, execute and emerge from financial restructuring or reorganization. She frequently leads complex mandates involving international operations, workforce reductions, litigation-related cases and/or transactions executed through § 363 sale processes. Chesley co-chairs the International Women’s Insolvency & Restructuring Confederation’s New York Chapter, and in 2021 she received an Emerging Leaders Award from The M&A Advisor. She also has been listed as one of Business Insider’s 15 Top Financial Public Relations Experts for 2020 and one of Consulting Magazine’s “Rising Stars of the Profession” for 2020, and she received PR Week’s Outstanding Young Professional award in 2018. Outside of restructuring, Chesley has led strategic transactions, merger-integration processes, executive transitions, workforce reductions and issues-management across a variety of industries and companies. Before entering the restructuring field, she was a high school English teacher in Newark, N.J., through Teach For America.

Chesley coaches four team members and spends a lot of her spare time in the office mentoring her team, which is largely comprised of young women. She also has continued her interest and support of education in client work for independent schools in New York City and Chicago, philanthropic and volunteer work with organizations like the Bubble Foundation (now Edible Schoolyard), and pro bono projects for clients.

“The members of the 2023 class are an inspiration for the commitment, creativity and ingenuity that they demonstrate in both their careers and communities,” said ABI Executive Director Amy Quackenboss. “This diverse collection of honorees is comprised of future leaders that will drive ABI and the insolvency community forward.”
