Bankruptcy Ethics Update: Part I
This panel discusses recent issues with ethical implications arising in bankruptcy cases, such as the duties of directors and their professionals in complex multi-debtor cases, including whether it is necessary to obtain a conflict waiver; issues arising from representing current, recent and former clients; what it means to be directly adverse versus positionally adverse; relatedness to a prior matter; use of confidential information; disinterestedness standards under U.S.C. ยง 101(14) and related disclosure requirements; and the ABI Report on the Standards of Professional Courtesy and Conduct.
