ABI's Navigating Banking in Bankruptcy Provides Insights on Issues That Occur at the Intersection of Banking and Bankruptcy

Alexandria, Va. — ABI’s Navigating Banking in Bankruptcy is a new comprehensive guide for bankers, company financial officers and legal professionals, offering practical guidance on issues that arise at the intersection of banking and bankruptcy. Co-authors Lisa Bittle Tancredi, a partner with Gebhardt & Smith LLP (Baltimore), and Mark A. Gittelman, Managing Chief Counsel – Bankruptcy and Business Reorganization for PNC Bank (Philadelphia), recently participated in a podcast to talk about their reasons for writing the book and to cover some of the key points of Navigating Banking in Bankruptcy.

The book includes checklists for bankers, debtors and their lawyers as aids for flagging issues before they become problems, and offers suggestions for smoothing the transition into debtor-in-possession banking. The guide also covers cash collateral, debtor-in-possession financing and cash management from the perspective of the deposit bank. “I couldn't find a book that encompassed these topics,” Tancredi said on her motivation for co-writing the book.

“Many people outside the banking world don't really understand how the banking products work and don't understand how bankruptcy would affect them,” Gittelman added.

Consumer privacy, credit card liability, treasury management systems and garnishment are among the issues that Navigating Banking in Bankruptcy touches on to provide a thorough analysis of both the legal and banking perspectives. “It helps identify which questions to ask,” Tancredi said.

It is also helpful for the U.S. Trustee, judges and others in the court system to help them understand what goes on in a bank from a depository point of view,” Gittelman said. “Many of them have a good sense of what banks do by way of being a creditor. But as a depositor, it can be somewhat opaque to the rest of the world about how banks work, and this book attempts to open that door a little bit.”
