Individual Chapter 13 Filings Increase 32 Percent in Calendar Year 2022

Total Bankruptcy Filings Down 6 Percent

Jan. 5, 2023 –  Individual Chapter 13 bankruptcy filings during calendar year 2022 (Jan. 1-Dec. 31) increased 32 percent to 149,072 from the 2021 total of 112,913, according to data provided by Epiq Bankruptcy, the leading provider of U.S. bankruptcy filing data. While representing a substantial year-over-year increase, individual Chapter 13 filings remain lower than the pre-pandemic total of 272,451 recorded in calendar year 2019.

Overall individual filing totals for calendar year 2022 were down six percent to 356,930 from the 378,918 individual filings the previous year. Individual filings are at their lowest levels since the 341,233 filings registered in 1985.

The 378,326 total bankruptcy filings in calendar year 2022 also registered a six percent decrease from the 401,479 filings during calendar year 2021. Annual bankruptcy filings last registered a similar total in 1984, with 348,521 total filings. Commercial filings also declined, as 21,396 filings in calendar year 2022 represented a five percent drop from the 22,561 filings recorded in calendar year 2021.

Commercial Chapter 11 filings increased 2 percent to 3,816 in calendar year 2022 from the previous year’s total of 3,726. Subchapter V elections within Chapter 11 also experienced an increase in calendar year 2022, as the 1,433 filings represented a 13 percent jump from the 1,263 filings recorded in 2021.

“The underlying data tells different year-over-year economic stories. The Chapter 7 story is encouraging with new filings down 21.6 percent. The Chapter 11/11V story is business as usual with new filings slightly up 1.2 percent, and the Chapter 13 story looks bleak as new filings were up 32 percent,” said Gregg Morin, VP Business Development and Revenue for Epiq Bankruptcy. “But if you are in the bankruptcy servicing business there is still another story as all three chapters had more cases close in 2022 than new cases filed. Chapter 7 filings had 29,799 more cases closed than opened, Chapters 11/11V had 265 more closed, and Chapter 13s had 44,361 more closed. Every month in 2022, all chapter totals had more cases close than open totaling 74,678 for the year, continuing the annual trend since 2011,” Morin added.

“Steep bankruptcy filing declines abated over the past year as pandemic assistance programs and lender forbearance receded while interest rates, inflationary pressures and debt loads grew,” said ABI Executive Director Amy Quackenboss. “As struggling families and companies face mounting economic pressures at the start of 2023, bankruptcy provides a proven shield toward a financial fresh start.”

All filing categories registered an increase in December 2022 compared to the previous year. Total bankruptcy filings increased six percent to 29,631 in December over the 27,997 total filings in December 2021. The 27,919 individual filings also represented a six percent rise over the 26,306 filings in December 2021. Total commercial filings for December were 1,712, an increase of one percent over the 1,691 total commercial filings in December 2021. Commercial Chapter 11 filings increased 3 percent to 326 in December 2022 from the 316 filings in December 2021. December 2022 subchapter V small business filings registered the largest increase — 51 percent — as the 128 subV elections were double the 84 registered in December 2021. While still below pre-pandemic levels, individual Chapter 13 filings continued to increase in December as well, as 12,397 filings were up 24 percent over the December 2021 total of 10,028.

ABI Lifetime Achievement Award Renamed to Honor William A. Brandt, Founder of Development Specialists, Inc.

Alexandria, Va. — The American Bankruptcy Institute (ABI) announces that its highest award, ABI’s Lifetime Achievement Award, which recognizes the recipient’s sustained and deep commitment to the leadership and governance of the organization, has been renamed after William A. Brandt, founder of Development Specialists, Inc. (Chicago). ABI proclaimed on Dec. 9 during its Winter Leadership Conference in Palm Springs, Calif., that the award will now be called the Bill Brandt Lifetime Achievement Award.

An ABI member since 1987, Brandt served on ABI’s Board of Directors, was a commissioner on ABI’s Commission to Study the Reform of Chapter 11, and served on the Advisory Boards of ABI’s New York City Bankruptcy Conference and Bankruptcy Battleground West program. He is currently living and working with the rare condition of Amyotrophic Lateral Sclerosis (ALS), a nervous system disease that weakens muscles and impacts physical function.

Brandt has been in the business of workout, turnaround and insolvency consulting for 47 years and is widely recognized as one of the foremost practitioners in the field. He is President and CEO of Development Specialists, Inc. (DSI), a firm specializing in the provision of management, consulting and turnaround assistance to troubled or reorganizing enterprises. While his firm operates offices throughout the country, he lives and works in his native city of Chicago.

Brandt's political, legislative and civic endeavors have spanned almost four decades. He has continually advised Congress on matters of insolvency and bankruptcy policy, and in that capacity was the principal author of the amendment to the Bankruptcy Code permitting the election of trustees in chapter 11 cases. He also was involved in drafting several amendments to the Bankruptcy Code that were enacted into law in April 2005 as part of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, which substantially rewrote the nation’s bankruptcy laws.

Brandt is a frequent writer, lecturer and speaker on topics of corporate restructuring, bankruptcy and related public policy issues, and is routinely featured as an expert appearing in a wide range of media outlets to discuss those topics.

Alexandria, Va. ABI announces that Brad M. His experience spans a broad spectrum of industries, including energy, telecommunications, financial services, transportation, technology and media. Kahn is recognized as a “Recommended” restructuring lawyer by Legal 500 (2022), an “Outstanding Young Bankruptcy Lawyer” by Turnarounds & Workouts (2019) and a “Rising Star” by Super Lawyers (2016-2018). Herman is a partner in Dechert LLP’s Financial Restructuring group. He focuses on representing debtors, official and ad hoc committees, creditors, asset-acquirers and other interested parties in chapter 11 bankruptcy cases, cross-border insolvency matters, out-of-court restructurings, and restructurings of sovereign and governmental debt. Herman also has broad experience in commercial litigation matters, including securities litigation, shareholder derivative litigation, mergers and acquisitions litigation, and other complex disputes. In addition, he is deeply involved in pro bono work. At his prior firm, he led its pro bono representations of children with disabilities for whom housing issues posed an obstacle to their care. He assisted a child with asthma whose public housing apartment was infested with mold, coming within days of suing a city agency before the agency finally moved his family to a new home. He similarly helped the family of a child with a genetic disease avoid eviction and find new housing that could accommodate the child’s medical equipment. At his current firm, his pro bono practice focuses on human trafficking. Herman received his J.D. magna cum laude in 2007 from the New York University School of Law and his B.A. summa cum laude in 2004 from the University of Pennsylvania.

Thomas B. Fullerton of Akerman LLP Selected as One of ABI's 2022 "40 Under 40"

Alexandria, Va. ABI announces that Thomas B. Fullerton is a partner with Akerman LLP’s Bankruptcy Group and a Major in the U.S. Army JAG Corps. His creditor practice includes the representation of traditional banks, loan-servicers, private lenders and commercial landlords in all facets of bankruptcy proceedings, and he represents transferees (including insurance companies/brokers, debt-buyers and individuals) in preference and fraudulent-transfer claims. Fullerton also has performed creditors’ rights litigation for banks and servicers, including mortgage foreclosures, receiverships, mechanics’ liens, and breach-of-note/guaranty and other affirmative matters. As a Judge Advocate in the Army, he is the Deputy Regional Defense Counsel for the Central Region of the 22nd Legal Operations Detachment, and in that capacity he defends soldier-clients who are facing charges and administrative matters, including Article 15s and discharge actions. November Commercial Chapter 11 Bankruptcies Increase 74 Percent Over Last Year

Dec. 5, 2022 — Commercial chapter 11 filings increased 74 percent to 345 in November 2022 from the 198 filings recorded in November 2021, according to data provided by Epiq Bankruptcy, the leading provider of U.S. bankruptcy filing data.

The November 2022 commercial chapter 11 filing total was lifted by the more than 100 cases related to the chapter 11 filing on November 11 by crypto exchange FTX Trading, Ltd. Total commercial filings increased 17 percent to 1,848 in November over 1,586 total filings in November 2021. Subchapter V small business filings increased 38 percent to 117 in November 2022 from 85 filings in November 2021.

Total U.S. bankruptcy filings in November 2022 were 31,178, up six percent from 29,335 total filings in November 2021. Overall individual filings also increased six percent in November 2022, as 29,330 filings were up over 27,749 individual filings recorded in November 2021. While still below pre-pandemic levels, individual chapter 13 filings continued to increase in November, as 12,862 filings were up 25 percent over the November 2021 total of 10,327.
 
“Despite the month-to-month reduction in filings nationally, 13 states still had double-digit month-over-month increases in the percentage of total commercial filings and seven states had double-digit increases in individual filings,” said Gregg Morin, Vice President of Business Development and Revenue for Epiq Bankruptcy. “Even though more than 100 cases were influenced by a single crypto bankruptcy case, there will always be regional fluctuations, both higher and lower.”   
 
States with the highest percentage increases in commercial filings included DE, ID, NE, AL, SD, MN, MS, OK, MI, IN, NC, KS and NJ. States with the most individual filings percentage increases were AK, WV, SD, OR, KS, DE and ND.
 
“Rising debt loads, increasing interest rates and inflationary pressures are presenting families and businesses with difficult economic challenges to navigate,” said ABI Executive Director Amy Quackenboss. “Bankruptcy provides a lifeline to financially struggling households and businesses during uncertain economic times.”
 
Almost all filing chapters in November registered a decrease compared to October’s figures. November’s total bankruptcy filings represented a five percent decrease when compared to the 32,696 total filings recorded the previous month. Total individual filings for November represented a five percent decrease from the October 2022 individual filing total of 30,792. Individual chapter 13 filings also registered a six percent decrease from October’s individual chapter 13 total of 13,619. The commercial filing total represented a three percent decrease from the October 2022 commercial filing total of 1,904. Conversely, commercial chapter 11 filings registered a 13 percent increase from the 305 filings the previous month due in large part to the related cases of the FTX filing. Subchapter V elections within chapter 11 decreased 11 percent from the 132 filed in October 2022.

Ford is a partner and Corporate Maintenance leader at Goosmann Law Firm, where he is a litigation and transactional attorney who represents creditors, banks and business leaders in civil and commercial litigation, out-of-court workouts, and chapter 7, 11 and 13 bankruptcy proceedings, including adversary proceedings. He also routinely assists clients with complex business transactions and asset acquisitions. Ford was named on the 2021, 2022 and 2023 The Best Lawyers in America “Ones to Watch” lists for Bankruptcy and Creditor/Debtor Rights/Insolvency and Reorganization Law. He also was recently named a 2022 Super Lawyers “Rising Star.” In addition, he is an Executive Committee member of the Nebraska State Bar Association’s Banking & Bankruptcy Sections, and he is a member of the Young Lawyers Division through the Iowa State Bar Association. He also is a member of the National Association of Minority and Women Owned Law Firms (NAMWOLF) and an active member of NAMWOLF’s Financial Services Litigation Practice Area Committee, through which he helps promote NAMWOLF members who concentrate on both offensive and defensive financial services litigation to major financial services companies. Ford received his J.D. in 2011 from the University of Nebraska College of Law and his B.A. in political science in 2008 from Creighton University.

Gianfranco Finizio of Kilpatrick Townsend & Stockton LLP Selected as One of ABI's 2022 "40 Under 40"

Alexandria, Va. ABI announces that Gianfranco Finizio of Kilpatrick Townsend & Stockton LLP (New York) has been selected as one of ABI’s “40 Under 40,” ABI’s annual program that recognizes 40 of the top insolvency industry professionals under the age of 40. The honorees will be recognized at a special ceremony on Dec. 9 at ABI’s 2022 Winter Leadership Conference at the La Quinta Resort & Club in La Quinta, Calif.

Finizio is a partner at Kilpatrick Townsend & Stockton LLP, where he advises and represents a diverse range of clients, including official committees of unsecured creditors, indenture trustees, debtors, bank agents, and major secured and unsecured creditors in complex chapter 11 bankruptcy cases, out-of-court restructurings and other distressed situations. He has been listed in the 2021 and 2022 editions of Chambers USA: America’s Leading Lawyers for Business in the area of Bankruptcy/Restructuring (Up & Coming) and recognized as a New York “Rising Star” for the past eight years for Business Bankruptcy in Super Lawyers. Finizio’s pro bono activities include working with KIND (Kids in Need of Defense), a nonprofit that offers legal counsel to unaccompanied refugees and immigrant children; through the organization, he provides legal services to children in need. He also mentors new Kilpatrick Townsend associates, including participating in coaching sessions and yearly reviews. Finizio received his J.D. in 2009 from St. John's University School of Law and his B.B.A. cum laude in 2006 from George Washington University.
